1. Acceptance of Terms

By downloading, installing, or using Inner Sphere ("App", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User", "you", "your") and Lucid Code Labs ("Company", "we", "us", "our").

2. Eligibility

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the App, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

3.1 Account Creation

To use most features of the App, you must create an account by providing a valid email address and password, or by signing in through Apple Sign In or Google Sign In.

3.2 Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must provide accurate, current, and complete information during registration.
  • You must notify us immediately of any unauthorized use of your account.
  • You may not create multiple accounts to circumvent restrictions, including subscription trial limits.

3.3 Username Policy

Your username must not:

  • Impersonate another person or entity
  • Contain offensive, vulgar, or discriminatory language
  • Violate any third-party intellectual property rights

We reserve the right to reclaim or reassign usernames at our discretion.

4. Description of Service

Inner Sphere is a wellness application that provides tools for:

  • Meditation — Guided timer sessions with ambient sounds, binaural beats, breathing guides, and post-session reflections
  • Breathwork — Structured breathing exercises with multiple techniques
  • Fasting — Fasting timers with stage tracking, journaling, and body measurement logging
  • Mood Tracking — Multi-dimensional emotional check-ins and trend analysis
  • Gratitude Journaling — Daily gratitude prompts and entries
  • Question Game ("Who Am I") — Self-exploration question game with optional AI-generated follow-ups
  • Social Features — Friends, direct messaging, a social feed, and activity presence sharing
  • Body Tracking — Weight and custom body measurement logging

5. Health and Wellness Disclaimer

5.1 Not Medical Advice

Inner Sphere is a wellness and mindfulness tool. It is NOT a medical device, and it does NOT provide medical advice, diagnosis, or treatment.

The information, features, and content provided through the App — including but not limited to meditation guidance, breathwork techniques, fasting timers, mood tracking, and body measurements — are for general wellness and informational purposes only.

5.2 Consult a Professional

  • Always consult a qualified healthcare provider before starting any fasting regimen, breathing exercise program, or making changes to your health routine.
  • If you have or suspect a medical condition, mental health condition, eating disorder, or any health concern, seek professional medical advice before using the App.
  • Do not disregard professional medical advice or delay seeking it because of information provided by the App.

5.3 Fasting Risks

Fasting can pose serious health risks, including but not limited to dehydration, electrolyte imbalances, hypoglycemia, and adverse effects for individuals with diabetes, eating disorders, pregnancy, or other medical conditions. The fasting tools in this App are informational aids only. You fast at your own risk.

5.4 Breathwork Risks

Certain breathwork techniques (such as Wim Hof, Tummo, or Shamanic breathing) involve hyperventilation and extended breath holds that may cause dizziness, lightheadedness, tingling, or loss of consciousness. Never practice breathwork while driving, swimming, in water, or in any situation where loss of consciousness could be dangerous. Consult a healthcare provider before beginning any breathwork practice, especially if you have cardiovascular, respiratory, or neurological conditions.

5.5 AI-Generated Content

The App may use artificial intelligence (Google Gemini) to generate follow-up questions, meditation insights, and other content. AI-generated content is not reviewed by healthcare professionals and should not be relied upon as medical, psychological, or professional advice.

5.6 Limitation of Liability for Health Outcomes

We are not liable for any health outcomes, injuries, or adverse effects resulting from your use of the App's wellness features. You assume full responsibility for your health decisions.

6. Subscriptions and Payments

6.1 Free and Premium Tiers

The App offers both free and premium subscription tiers. Certain features may be restricted to premium subscribers.

6.2 Free Trial

We may offer a free trial period for the premium subscription. The trial is limited to one per user and per Apple ID or Google account. Attempts to obtain multiple trials through multiple accounts are prohibited and may result in account termination.

6.3 Payment Processing

All subscriptions are processed through the Apple App Store (iOS) or Google Play Store (Android). By subscribing, you agree to the payment terms of the applicable app store.

6.4 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the end of the current period.

6.5 Cancellation

You may cancel your subscription at any time through your device's app store subscription settings:

  • iOS: Settings > Apple ID > Subscriptions
  • Android: Google Play Store > Subscriptions

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the period expires. Refunds are subject to the policies of Apple or Google, as applicable.

6.6 Price Changes

We reserve the right to change subscription prices. You will be notified of price changes in advance, and any increase will apply to the next billing cycle after the notice period.

7. User Content

7.1 Your Content

"User Content" includes any text, images, audio, or other material you create, upload, or share through the App, including but not limited to: profile information, journal entries, meditation insights, mood entries, gratitude entries, social feed posts, chat messages, voice notes, and game responses.

7.2 Ownership

You retain ownership of your User Content. By submitting User Content to the App, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and distribute your User Content solely for the purpose of operating, improving, and providing the Service. This license terminates when you delete your User Content or your account, except where your content has been shared with other users (e.g., messages sent, feed posts viewed by others).

7.3 Content Shared with Others

Content you share through social features (feed posts, messages, activity presence) may be viewed by other users. Once shared, you may not be able to control how others use or remember that content. Exercise discretion when sharing personal or sensitive information.

7.4 Voice Notes

Voice note recordings are stored exclusively on your device and are not uploaded to our servers. You are solely responsible for the security of locally stored voice recordings.

8. Community Guidelines and Prohibited Conduct

8.1 General Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Harass, abuse, threaten, bully, or intimidate other users
  • Post or transmit content that is hateful, discriminatory, obscene, defamatory, or promotes violence
  • Impersonate any person or entity or misrepresent your affiliation
  • Send spam, unsolicited messages, or commercial solicitations through the messaging feature
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use automated tools, bots, scrapers, or scripts to access or interact with the App
  • Interfere with or disrupt the App's servers, networks, or infrastructure
  • Reverse engineer, decompile, or disassemble any part of the App
  • Circumvent any technical measures we use to enforce these Terms, including subscription trial restrictions
  • Upload content that contains malware, viruses, or harmful code
  • Collect or harvest other users' personal information without their consent

8.2 Content Standards

User Content shared through social features must comply with our community guidelines. We reserve the right to remove content that violates these Terms or community guidelines without prior notice.

8.3 Reporting

If you encounter content or behavior that violates these Terms, please report it through the App or contact us at the email address listed in Section 18.

9. Intellectual Property

9.1 Our Property

The App, including its design, code, features, graphics, logos, trademarks, and all associated intellectual property, is owned by Lucid Code Labs and is protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9.3 Restrictions

You may not:

  • Copy, modify, or create derivative works of the App
  • Distribute, license, sell, or commercially exploit the App
  • Use our trademarks, logos, or brand assets without prior written permission
  • Remove any copyright or proprietary notices from the App

9.4 Question Content

The questions and content within the "Who Am I" game are proprietary. You may not reproduce, distribute, or commercially use this content outside of the App.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your information.

11. Third-Party Services

11.1 Third-Party Integrations

The App integrates with third-party services including Supabase, Google Gemini AI, RevenueCat, PostHog, Klipy, Google Places API, Expo, and Firebase. Your use of these services is subject to their respective terms and privacy policies.

11.2 App Store Terms

Your use of the App is also subject to the terms of the Apple App Store or Google Play Store from which you downloaded the App.

11.3 GIF Content

GIFs available in the chat feature are provided by third-party services. We are not responsible for the content of third-party GIFs.

12. Disclaimers

12.1 "As Is" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 No Guarantee of Availability

We do not guarantee that the App will be available at all times, uninterrupted, secure, or error-free. We may modify, suspend, or discontinue the App or any feature at any time without notice.

12.3 Data Accuracy

We do not guarantee the accuracy, completeness, or reliability of any data, statistics, or insights generated by the App, including AI-generated content, wellness tracking data, and fasting stage information.

12.4 Offline Functionality

Certain features require an internet connection. Offline functionality is limited, and data created offline will sync when connectivity is restored. We are not responsible for data loss due to sync failures.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • WE SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or property damage arising from your use of the App.
  • OUR TOTAL AGGREGATE LIABILITY for all claims arising from or related to these Terms or the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.
  • WE ARE NOT LIABLE for any health consequences, injuries, or adverse effects resulting from your use of the wellness features, including meditation, breathwork, fasting, or body tracking tools.

These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

14. Indemnification

You agree to indemnify, defend, and hold harmless Lucid Code Labs, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

  • Your use of the App
  • Your violation of these Terms
  • Your User Content
  • Your violation of any rights of a third party
  • Any health decisions you make based on information from the App

15. Account Termination

15.1 Termination by You

You may stop using the App at any time. To request deletion of your account and associated data, please contact us at the email address listed in Section 18.

15.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms or community guidelines
  • Fraudulent activity, including attempts to obtain multiple free trials
  • Conduct that is harmful to other users or the integrity of the Service
  • Extended periods of inactivity
  • Any other reason at our sole discretion

15.3 Effect of Termination

Upon termination:

  • Your right to use the App ceases immediately
  • We may delete your account data in accordance with our Privacy Policy
  • Provisions of these Terms that by their nature should survive termination (including Sections 5, 7.2, 9, 12, 13, 14, and 16) shall survive

16. Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [INSERT STATE/JURISDICTION], without regard to conflict of law principles.

16.2 Informal Resolution

Before filing any formal dispute, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days.

16.3 Arbitration

16.4 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this waiver is found unenforceable, the entirety of this arbitration provision shall be null and void.

16.5 Exceptions

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters relating to intellectual property or unauthorized access to the Service.

17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lucid Code Labs regarding the App.

17.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, acts of government, internet or infrastructure failures, or pandemics.

17.6 Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last Updated" date. Your continued use of the App after the effective date of revised Terms constitutes your acceptance of the changes.

17.7 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights, except that Apple and Google are intended third-party beneficiaries of these Terms as required by their respective app store terms.
